ITC Reverses 337 Suspension

The US International Trade Commission voted Friday to reverse the suspension of the Section 337 investigation into the imports of carbon and alloy steel products from China.
The investigation was initiated on June 2, 2016 following a complaint filed by US Steel Corp alleging price fixing, theft of trade secrets and false designation of origin or manufacturer by Chinese steel producers and distributors. The presiding law judge suspended the investigation on July 6, 2016 to allow time for the Commission to provide the required statuary notice to Commerce given that the investigation was partly under the purview of antidumping and countervailing duty laws, which were, in part, already before Commerce.
On July 11, the Secretary of Commerce, Penny Pritzker, acknowledged the suspension and identified two investigations that “potentially could come within the scope of the Commission’s investigation.” US Steel filed a petition on July 13, 2016, asking for the suspension to be reviewed.
The USITC will now resume the investigation and provide the reasons for revoking the suspension in an upcoming document.
